This Agreement covers your participation in a pilot or field test of the ElderOrbit application (the "Beta Program"), operated by ElderOrbit, Inc.. It supplements, and does not replace, the Terms of Service and Privacy Notice.
1. Purpose of the Beta Program
The Beta Program lets a limited group of families and caregivers try ElderOrbit before general availability, so we can validate the care-coordination workflow and fix problems before wider release.
2. Voluntary Participation & Eligibility
Participation is voluntary. You may withdraw at any time (see Section 7). Participants are expected to be at least 18 years old and legally able to make decisions for the care recipient(s) they add, or to be the designated family representative for that person.
3. Nature of Beta Software
[PLACEHOLDER — confirm with counsel.] Beta software is provided "as is," without warranty of any kind. Features may be incomplete, change without notice, or be removed. We do not guarantee uptime, data durability, or that the Service will be free of bugs during the Beta Program. Do not rely on ElderOrbit as your sole record of care during this period — keep your own backup notes for anything safety-critical.
4. Data Collected During the Field Test
[PLACEHOLDER — confirm exact scope with engineering before publishing.] In addition to the data described in our Privacy Notice, during the Beta Program we may collect additional diagnostic information to help us improve the product: feature usage patterns, error and crash reports, and any feedback you submit through in-app feedback tools.
5. Protected Health Information & BAA Status
The same PHI and Business Associate Agreement status described in the Terms of Service (Section 3) and the HIPAA & Health Data Notice applies during the Beta Program. Do not enter PHI for which a BAA is legally required until we confirm BAA coverage in writing.
6. Confidentiality of Beta Features & Your Feedback
[PLACEHOLDER — confirm with counsel.] Unreleased features you see during the Beta Program are confidential until publicly announced. By submitting feedback, you agree we may use it to improve ElderOrbit without owing you compensation. We will not publish your name or identifying details alongside feedback without asking you first.
7. Your Right to Withdraw
You may stop participating in the Beta Program at any time by closing your account from Settings → Privacy or by contacting us. Withdrawing does not affect any rights you have under the Terms of Service or Privacy Notice.
8. Changes, Suspension, or Discontinuation
We may change, suspend, or discontinue any Beta Program feature at any time, with or without notice, and may end the Beta Program entirely as ElderOrbit moves toward general availability.
9. Relationship to Other Policies
This Agreement is incorporated by reference into, and read alongside, the Terms of Service and Privacy Notice. Where this Agreement is silent, those documents control.
10. How Consent Is Recorded
Your acceptance of this Agreement is recorded the same way as our other policies — visible any time from Settings → Privacy.
11. Governing Law & Contact
This Agreement is governed by the laws of [PLACEHOLDER — Governing law / jurisdiction]. Questions: support@elderorbit.ai.
